A haulage firm has been fined £5,000 and ordered to pay a further £4,900 in costs after it was found that they had created “a real risk of a major fire” at their Leicestershire site.

The Health and Safety Executive (HSE) decided to prosecute A.M Widdowson & Son Ltd when it was discovered that they had been illegally storing large quantities of liquid petroleum gas for several months and had failed to properly manage the risks involved.

The company, who are based at Mill Lane Industrial Estate, pleaded guilty to breaching Regulation 6(2) of the Control of Major Accident Hazards Regulations 1999 (COMAH) and Section 2(1) of the Health and Safety at Work Act 1974 at Coalville Magistrates Court.

Under the COMAH regulations companies who store aerosol products are obligated to notify the authorities of their onsite operations and they should also complete a full risk assessment. A.M Widdowson & Son Ltd neglected to take both of these steps and also failed to implement many other good practices recognised by industry.

Commenting on the case, HSE Inspector James Wright said: "The arrangements this company had in place for the storage of aerosol products fell well below what HSE would expect to find. On this occasion, with the amount of LPG being stored on site, there was a real risk of a major fire, which would have posed a threat to employees on site and those in the surrounding area.”
